Our Products and Services include, but are not limited to: Public Speaking, Life Coaching, Consulting, Literature, Apparel, Digital Content, and other related services.<\/p>\n  \n  <h3>2. Privacy Policy<\/h3>\n  <p>Your use of our Platforms is subject to Tondr\u00e9 Ol\u00e9 Speaks LLC&#8217;s <a href=\"https:\/\/tondreole.org\/privacy-policy\/\" target=\"_blank\" style=\"color: #000000; text-decoration: underline;\">Privacy Policy<\/a>. Please review our <a href=\"https:\/\/tondreole.org\/privacy-policy\/\" target=\"_blank\" style=\"color: #000000; text-decoration: underline;\">Privacy Policy<\/a>, which also governs the Platforms and informs users of our data collection practices.<\/p>\n\n  <h3>3. Use of AI and Interactive Features<\/h3>\n  <p>To enhance our Services, we may use Artificial Intelligence (AI) and other third-party technologies, particularly in our interactive features like <strong>the Clarity Compass<\/strong>. We are committed to your privacy and our promise of a &#8220;safe space&#8221;; we do not collect, share, <strong>archive<\/strong>, or sell any personal data, stories, or questions you may enter into our AI-powered interactive features. While we utilize third-party technologies, Tondr\u00e9 Ol\u00e9 Speaks LLC is not responsible for the data practices of these external entities or any potential misuse of information by them. However, should we be made aware of any such data abuse by a third-party service we employ, we are committed to informing our users.<\/p>\n  \n  <h3>4. Electronic Communications<\/h3>\n  <p>Visiting our Platforms (tondreole.com, tondreole.org, or our Apps) or sending emails to Tondr\u00e9 Ol\u00e9 Speaks LLC and its associates constitutes electronic communications. You consent to receive electronic communications and you agree that all agreements, notices, disclosures, and other communications that we provide to you electronically, via email, and on the Platforms, satisfy any legal requirement that such communications be in writing.<\/p>\n  \n  <h3>5. Your Account<\/h3>\n  <p>If you use our Platforms and create an account, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer. You agree to accept responsibility for all activities that occur under your account or password. You may not assign or otherwise transfer your account to any other person or entity. You acknowledge that Tondr\u00e9 Ol\u00e9 Speaks LLC is not responsible for third-party access to your account that results from theft or misappropriation of your account. Tondr\u00e9 Ol\u00e9 Speaks LLC and its associates reserve the right to refuse or cancel service, terminate accounts, or remove or edit content at our sole discretion.<\/p>\n  \n  <h3>6. Children Under Thirteen<\/h3>\n  <p>Tondr\u00e9 Ol\u00e9 Speaks LLC does not knowingly collect, either online or offline, personal information from persons under the age of thirteen. No Unlawful or Prohibited Use\/Intellectual Property<\/h3>\n  <p>You are granted a non-exclusive, non-transferable, revocable license to access and use our Platforms strictly in accordance with these Terms of Use. Third-Party Accounts<\/h3>\n  <p>You may be able to connect your Tondr\u00e9 Ol\u00e9 Speaks LLC account to third-party accounts. By doing so, you acknowledge and agree that you are consenting to the continuous release of information about you to others (in accordance with your privacy settings on those third-party sites).<\/p>\n  \n  <h3>10. International Users<\/h3>\n  <p>The Services are controlled, operated, and administered by Tondr\u00e9 Ol\u00e9 Speaks LLC from our offices within the USA. If you access the Services from a location outside the USA, you are responsible for compliance with all local laws.<\/p>\n\n  <h3 class=\"section-divider\">LIFE COACHING SESSION BOOKING TERMS AND CONDITIONS<\/h3>\n  <p>Please read these Terms and Conditions carefully before booking any coaching session. By proceeding with your booking, you agree to be bound by these specific Life Coaching Session Booking Terms and Conditions.<\/p>\n  \n  <h4>1. Services Offered<\/h4>\n  <p>Tondr\u00e9 Ol\u00e9 Speaks LLC provides professional life coaching services via phone and Zoom. These services are designed to support clients in achieving personal and professional goals. Life coaching is not a substitute for therapy, counseling, or medical diagnosis.<\/p>\n\n  <h4>2. Eligibility<\/h4>\n  <p>By booking a session, you confirm that you are at least 18 years of age.<\/p>\n\n  <h4>3. Booking and Payment<\/h4>\n    <ul>\n      <li><strong>a. Booking Process:<\/strong> All sessions must be booked through our online scheduling system.<\/li>\n      <li><strong>b. Payment:<\/strong> Full payment for coaching sessions is required at the time of booking. Discovery Calls are complimentary.<\/li>\n      <li><strong>c. Confirmation:<\/strong> You will receive an email confirmation with your session details.<\/li>\n    <\/ul>\n\n  <h4>4. Rescheduling and Cancellations<\/h4>\n    <ul>\n      <li><strong>a. Client Rescheduling:<\/strong> You may reschedule up to twenty-four (24) hours before your session without penalty.<\/li>\n      <li><strong>b. Client Cancellations:<\/strong> Cancellations with more than 24 hours notice receive a full refund. Cancellations with less than 24 hours notice and no-shows will result in forfeiture of the full session fee.<\/li>\n      <li><strong>c. Coach Cancellation:<\/strong> In the rare event we need to cancel, you will be offered a reschedule or a full refund.<\/li>\n    <\/ul>\n\n  <h4>5. Client Responsibilities<\/h4>\n  <p>You are responsible for your punctuality, being in a private environment, and ensuring your technical equipment works for Zoom sessions.<\/p>\n  \n  <h4>6. Confidentiality<\/h4>\n  <p>All individual coaching sessions are strictly confidential, except where there is a legal obligation to disclose information (e.g., threat of harm).<\/p>\n  \n  <h4>7. Disclaimer of Warranties; Limitation of Liability<\/h4>\n  <p>Tondr\u00e9 Ol\u00e9 Speaks LLC cannot guarantee specific outcomes or results. Your progress depends on your own commitment and effort.<\/p>\n  \n  <h4>8. Intellectual Property<\/h4>\n  <p>All materials provided during coaching sessions are the intellectual property of Tondr\u00e9 Ol\u00e9 Speaks LLC and are for your personal use only.<\/p>\n  \n  <h4>9. Termination of Services<\/h4>\n  <p>We reserve the right to terminate coaching services with any client at any time, with written notice. Any unused, pre-paid session fees will be refunded.<\/p>\n\n  <h3 class=\"section-divider\">GENERAL PROVISIONS APPLICABLE TO ALL SERVICES<\/h3>\n  \n  <h4>1. Indemnification<\/h4>\n  <p>You agree to indemnify, defend and hold harmless Tondr\u00e9 Ol\u00e9 Speaks LLC, its officers, directors, employees, agents, and third parties, for any losses, costs, liabilities, and expenses relating to or arising out of your use of the Platforms or Services.<\/p>\n\n  <h4>2. Arbitration<\/h4>\n  <p>Any dispute arising from these Terms shall be resolved by final and binding arbitration pursuant to the Federal Arbitration Act.<\/p>\n\n  <h4>3. Class Action Waiver<\/h4>\n  <p>Any arbitration will take place on an individual basis; class arbitrations and class\/representative\/collective actions are not permitted.<\/p>\n\n  <h4>4. Liability Disclaimer (General)<\/h4>\n  <p>THE INFORMATION, SOFTWARE, PRODUCTS, AND SERVICES ARE PROVIDED &#8220;AS IS&#8221; WITHOUT WARRANTY. TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL TONDR\u00c9 OL\u00c9 SPEAKS LLC BE LIABLE FOR ANY DAMAGES ARISING OUT OF THE USE OR PERFORMANCE OF THE PLATFORMS.<\/p>\n\n  <h4>5. Termination\/Access Restriction<\/h4>\n  <p>Tondr\u00e9 Ol\u00e9 Speaks LLC reserves the right to terminate your access to the Platforms and Services at any time, without notice. This agreement is governed by the laws of the State of New Jersey.<\/p>\n\n  <h4>6. Changes to Terms<\/h4>\n  <p>Tondr\u00e9 Ol\u00e9 Speaks LLC reserves the right to change the Terms under which its Services are offered.
